Account Registration

Eligibility and Age Requirements

  • Minimum age: You must be at least 18 years old and at least the minimum legal age for gambling in your province or territory of residence and physical location. For example, you must be at least 19 years old to play while located in Ontario.
  • Location restrictions: The Website is intended only for individuals who are physically located in Canada in jurisdictions where online gambling with the Operator is lawful and permitted by the relevant regulator. The Operator may block or restrict access based on your location.
  • Legal capacity: By registering, you confirm that you have legal capacity to enter into binding contracts under Applicable Law and that you are not self-excluded or otherwise prohibited from gambling.

Registration Process

  • Account creation: To become a Player, you must complete the registration form on the Website, providing accurate and complete information, including (where requested) your full name, date of birth, address, email, phone number, and any other mandatory fields.
  • Email verification: You may be required to verify your email address by clicking a confirmation link sent by the Operator. The Operator may suspend or restrict your Account until verification is completed.
  • Geo-location and identity checks: The Operator may use geo-location technologies and identity verification systems to confirm that you are in an eligible location and meet eligibility criteria before permitting gambling or withdrawals.

KYC and Verification (Know Your Customer)

  • Document requests: To comply with anti-money laundering (AML), counter-terrorist financing, and regulatory requirements, the Operator may request documents such as government-issued photo ID, proof of address, proof of payment method, and, in some cases, proof of source of funds.
  • Timing: Verification may be required upon registration, before your first withdrawal, upon cumulative deposits or winnings reaching certain thresholds, or at any time the Operator deems necessary.
  • Consequences of non-compliance: If you do not provide requested information or documents, or if the Operator cannot verify them to its reasonable satisfaction, the Operator may suspend or close your Account and withhold deposits and/or winnings as required or permitted by Applicable Law and regulatory rules.

Account Security and User Obligations

  • Accuracy of data: You must ensure that all information you provide is true, complete, and up to date. You must promptly update your details via the Website or by contacting customer support if any information changes.
  • Login credentials: You are responsible for keeping your username, password, and any other security details confidential. You must not share your Account with any third party.
  • Single Account: You may maintain only one real-money gambling Account with the Operator on the Website. Multiple or duplicate Accounts may be closed, and Bonuses may be cancelled.
  • Notification of unauthorized use: You must notify the Operator immediately if you suspect that your Account is being accessed or used by someone else. Until such notification is received and acknowledged, you are responsible for all activity on your Account.

Regional compliance note: Identity, age, and location checks may be stricter for Ontario Players due to AGCO and iGaming Ontario rules and for RoC Players due to Kahnawake Gaming Commission requirements.

Betting & Gameplay Rules

Placing Bets and Game Participation

  • Availability of Games: The Operator may offer different Games to Ontario Players and RoC Players in order to comply with the requirements of AGCO, iGO, KGC, and other regulators. Not all Games are available in all jurisdictions.
  • Minimum and maximum stakes: Each Game has its own minimum and maximum bet limits, which are displayed within the Game interface. You are responsible for checking these limits before placing a bet.
  • Bet confirmation: A bet is considered accepted when it appears in your Game history or Account transaction history after you initiate it and the relevant Game confirms acceptance. Once accepted, a bet cannot usually be cancelled or changed.
  • Automatic play: Features such as auto-play or quick-spin must be used responsibly. You remain fully responsible for all wagers placed using such features.

Game Rules, Results, and Malfunctions

  • Game-specific rules: Each Game has its own rules, paytables, and return-to-player (RTP) information provided by the game supplier. In case of any inconsistency between these Terms and a Game's on-screen rules, the Game rules will prevail for the determination of Game outcomes.
  • Determination of results: Game outcomes are determined by random number generator (RNG) systems or, in the case of live dealer Games, by real-world game events (such as cards drawn or roulette spins), as recorded by the Operator's or supplier's systems.
  • Malfunctions: If a Game misbehaves or a technical error occurs (for example, interrupted connection or misconfiguration), the Operator may void affected bets, adjust balances, and restore the Game state to the last valid position, in accordance with regulatory rules. Malfunction voids all pays and plays.

Conduct, Live Casino Behaviour, and Chat Rules

  • Prohibited conduct: You must not engage in collusion, match-fixing, chip-dumping, advantage play based on exploitation of bugs, use of bots or automated tools, or any other form of cheating or fraudulent behaviour.
  • Live casino and chat: Where chat features are available, you must:
    • Behave respectfully towards dealers, other players, and staff;
    • Not use hateful, racist, sexist, obscene, threatening, or harassing language;
    • Not advertise or promote other services or websites;
    • Not share personal or financial information of yourself or others.
  • Fair play enforcement: The Operator may investigate gameplay, suspend or close Accounts, and withhold funds (as permitted by Applicable Law and regulatory requirements) where evidence of prohibited conduct, misuse of technical vulnerabilities, or breach of these Terms is found.

Regional compliance note: The Operator may report suspected criminal or fraudulent activity to AGCO, iGaming Ontario, the Kahnawake Gaming Commission, law enforcement, and other competent authorities.

Bonus Terms

Eligibility and Activation

  • Offer details: The specific conditions for each Bonus or promotion (for example, minimum deposit, maximum bonus amount, wagering requirement, validity period, and eligible Games) are set out in the relevant offer terms on the Website ("Promotional Terms").
  • One per person: Unless expressly stated otherwise, each Bonus is limited to one per person, family, household address, payment method, IP address, and device.
  • Activation: A Bonus may require you to opt in, enter a bonus code, or meet a minimum deposit threshold. Some Bonuses may be credited automatically when you fulfil the qualifying conditions.

Wagering Requirements and Playthrough

  • Wagering requirements: Bonus funds and any winnings derived from Bonus funds typically must be wagered a specified number of times (for example, 20x, 30x or more) before they become withdrawable. The exact requirement is set out in the Promotional Terms.
  • Game contribution: Not all Games contribute equally to meeting wagering requirements. For example:
    • Most slots may contribute 100% of each wager;
    • Table Games and live casino Games may contribute a lower percentage or 0%;
    • Certain Games may be excluded entirely.
  • Bonus/real money order: Unless stated otherwise, wagers are deducted first from your Real Money Balance and then from your Bonus Balance. Only wagering from the Bonus Balance typically counts towards the wagering requirement.

Prohibited Play and Bonus Abuse

  • Restricted strategies: You must not engage in betting patterns or strategies designed to artificially meet wagering requirements with minimal risk, such as:
    • Placing offsetting bets (for example, betting on red and black in roulette simultaneously);
    • Placing low-risk bets until wagering is nearly complete, then placing high-stake bets; or
    • Using duplicate Accounts or collaborating with others to exploit promos.
  • Excluded Games: Certain Games may be excluded from Bonus play or may be subject to maximum bet rules while wagering a Bonus. These restrictions are listed in the Promotional Terms.
  • Consequences: If the Operator reasonably believes that you have abused a Bonus, breached Promotional Terms, or engaged in prohibited play, it may cancel Bonuses, void Bonus-related winnings, and, where required or permitted by Applicable Law and regulator rules, suspend or close your Account.

Combining Promotions and Expiry

  • No combination by default: Bonuses and promotions are not intended to be combined unless the Promotional Terms explicitly permit this. If multiple Bonuses are active, wagering may apply to them in a specified order, as stated on the Website.
  • Expiry: Bonuses, free spins, and related wagering requirements are time-limited. If you do not complete the wagering requirements within the indicated timeframe, any remaining Bonus Balance and associated winnings may be forfeited.

Regional compliance note: Certain types of offers may be restricted or prohibited for Ontario Players by AGCO and iGaming Ontario. Where a conflict exists, regulatory rules for your jurisdiction take precedence, and some promotions may not be available to you.

Payments & Withdrawals

Deposit Methods and Limits

  • Methods: The Operator may support deposits via credit and debit cards, Interac and other e-transfer services, bank transfers, and selected e-wallets. Where permitted by Applicable Law and by the relevant regulator, certain alternative payment methods (including, if specifically announced, approved digital assets) may also be supported; such methods may not be available to Ontario Players.
  • Limits: Minimum and maximum deposit amounts are displayed in the cashier section of the Website. The Operator may set individual limits based on risk and regulatory requirements.
  • Source of funds: You must only deposit funds from payment instruments held in your own name. Depositing on behalf of others or using third-party accounts is prohibited.

Withdrawals

  • Verification required: Before processing withdrawals, the Operator may require identity, payment method, and source-of-funds verification, even if such checks were previously performed.
  • Method of withdrawal: Where possible, withdrawals will be paid back to the same method used for deposit. If this is not possible, the Operator may offer alternative methods compliant with Applicable Law.
  • Processing times: The Operator aims to review and process withdrawal requests within a reasonable period (for example, within a few business days), but actual timing may depend on verification checks, payment providers, and regulatory requirements.
  • Limits: The Operator may impose daily, weekly, or monthly withdrawal limits. High-value withdrawals may be split into instalments, subject to Applicable Law and regulator rules.

Fees, Chargebacks, and Refunds

  • Fees: The Operator may charge reasonable administrative fees for processing certain payment methods, currency conversion, or manual handling. Any such fees will be disclosed in the cashier or explicitly at the time of transaction, where permissible.
  • Chargebacks: If you dispute a transaction, initiate a chargeback, or otherwise reverse a payment, the Operator may suspend or close your Account, deduct associated costs, and, where appropriate, report the incident to regulators and payment providers.
  • Refunds: Bets that have been validly placed and settled are generally non-refundable. In cases of technical error, malfunction, or other exceptional circumstances, the Operator may void affected bets and refund the stake or reinstate the correct balance in line with regulatory obligations.

Player funds protection note: The Operator manages Player funds in accordance with the requirements of iGaming Ontario, AGCO, and the Kahnawake Gaming Commission (as applicable), which may include obligations to segregate Player funds from the Operator's own operational funds to help protect Player balances.

Limitation of Liability

  • What the Operator is responsible for: The Operator will provide the Website and Games with reasonable skill and care and will use reasonable efforts to ensure that:
    • Game outcomes are generated fairly in accordance with approved RNG or live-game procedures; and
    • Account balances and transaction records are maintained accurately, subject to correction of obvious errors.
  • Exclusions: To the fullest extent permitted by Applicable Law, the Operator (and its affiliates, employees, and suppliers) is not liable for:
    • Losses arising from your own breach of these Terms or misuse of the Website;
    • Losses due to internet or communication failures, power outages, device malfunctions, or other technical issues outside the Operator's reasonable control;
    • Indirect, consequential, incidental, or special damages (including loss of profits, data, or business opportunities) related to your use of the Website.
  • Maximum liability: Subject to non-excludable rights under Applicable Law, the Operator's total aggregate liability to you for any claim relating to a particular bet, Game, or transaction is limited to the amount you staked on the bet, Game, or transaction giving rise to the claim.
  • Non-excludable liability: Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Applicable Law, including liability for fraud or fraudulent misrepresentation.

Responsible gambling note: You acknowledge that you may lose money by gambling. You should never wager more than you can afford to lose, and you are encouraged to use the responsible gambling tools and support resources made available on the Website and by provincial agencies in Canada.

Intellectual Property Rights

  • Ownership: All content on the Website, including text, graphics, logos, icons, images, audio and video clips, software, underlying code, and the arrangement and compilation of such content (collectively, "Content"), is owned by or licensed to the Operator or its licensors and is protected by copyright, trademark, and other intellectual property laws.
  • Permitted use: You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and its Content solely for your personal, non-commercial entertainment, subject to these Terms.
  • Prohibited use: You may not, without prior written consent from the Operator:
    • Copy, reproduce, modify, distribute, transmit, publicly display, or create derivative works from any part of the Website or Content;
    • Use any automated system (such as bots, spiders, or scrapers) to access or retrieve data from the Website;
    • Reverse engineer, decompile, or otherwise attempt to derive the source code of any software used in connection with the Website, except where permitted by law.
  • Trademarks: "High Flyer Casino", related logos, and other brand identifiers used on highflyerwin-ca.com are trademarks or trade names of the Operator or its affiliates. You may not use any such marks without the Operator's prior written permission.

Privacy & Data Protection

  • Privacy Policy: The Operator collects, uses, discloses, and protects your personal information in accordance with its Privacy Policy, which is available on the Website. That Privacy Policy forms part of these Terms.
  • Applicable privacy laws: The Operator processes personal data in accordance with Applicable Law, which may include Canadian federal and provincial privacy legislation, and with the data protection requirements imposed by AGCO, iGaming Ontario, and the Kahnawake Gaming Commission, as applicable.
  • Your obligations: You must ensure that the personal information you provide is accurate and that you do not misuse any personal or confidential information obtained through the Website, including information about other Players.

Note: By using the Website, you consent to the processing of your personal information as described in the Privacy Policy. If you do not agree with the Privacy Policy, you must stop using the Website.

Changes to Terms

  • Right to modify: The Operator may amend these Terms (including any documents incorporated by reference) from time to time to reflect changes in law, regulatory requirements, or the services offered on the Website.
  • Notice of changes: Material changes will be communicated by appropriate means, which may include:
    • Posting the updated Terms on the Website with a new "effective date"; and/or
    • Displaying an in-account notification, pop-up, or banner; and/or
    • Sending an email to the address associated with your Account, where feasible.
  • Acceptance of changes: Continued use of the Website after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to an updated version, you must stop using the Website and may request closure of your Account.

Regulatory note: Any changes required by AGCO, iGaming Ontario, the Kahnawake Gaming Commission, or other regulators may take effect immediately or as otherwise mandated by those authorities.

Termination & Suspension

By the Player

  • Closing your Account: You may request closure of your Account at any time by using the relevant function on the Website (if available) or by contacting customer support.
  • Withdrawals on closure: Subject to verification and any ongoing investigation, you may withdraw any remaining Real Money Balance at the time of closure, provided such withdrawal is permitted under these Terms and Applicable Law.

By the Operator

  • Grounds for suspension or termination: The Operator may suspend or terminate your Account, withhold Bonuses, freeze or confiscate funds (where allowed by Applicable Law and regulatory rules), or restrict your access to the Website if:
    • You breach these Terms or the rules of a specific Game or promotion;
    • You provide false, misleading, or incomplete information;
    • There is suspicion of fraud, money laundering, terrorist financing, or other unlawful conduct;
    • You are underage or otherwise ineligible to use the Website;
    • You initiate chargebacks or conduct abusive behaviour towards staff or other Players; or
    • Regulators or other competent authorities require or request such action.
  • Notice: Where permitted by Applicable Law and regulatory requirements, the Operator will use reasonable efforts to notify you of the reasons for suspension or termination. However, in some cases, particularly where required by law or regulator instructions, the Operator may be unable to provide prior or detailed notice.

Effect of Termination

  • Outstanding obligations: Termination does not affect any rights or obligations that have accrued up to the time of termination, including the Operator's right to recover any amounts owed or to cooperate with law enforcement and regulators.
  • Funds on termination: If your Account is closed, the treatment of any remaining funds will depend on the reason for closure and Applicable Law. Where closure is not related to prohibited conduct, the Operator will normally pay out any Real Money Balance to you, subject to verification. Where closure relates to suspected or confirmed unlawful activity or breach of regulatory rules, the Operator may be required to withhold or forfeit funds in accordance with regulator directions or Applicable Law.
